Is it legal for Married Woman to Give Baby HER Maiden Name instead of the Husband's Name

My soon to be exwife gave birth to our son in december , it is now february and we are still married and she gave our son her maiden last name can she do that lawfully?  (Last changed: February 26, 2006 )

oh my god!!! if i were you i would be doing everything possible to get that baby's name changed. for one it is wrong for that baby not to be carrying either your name or your x's. there has to be something you can do. as for your x she should have made damn sure who the father was before she went labeling someone else's name to that kid. how is he going to feel 10 years down the road with a last name that means absolutely nothing to him? it has no history to him. i am sorry but that is outrageous what she did and it sounds like no effort is being made on her part to switch the name. at least let it go back to her maiden name. so at least it is a name which he came from. i am so sorry for you right now. you sound like a very good dad. i wish you luck with the legal battle.   (Last changed: February 26, 2006)
